The Government of Ukraine has clarified the procedure for exporting rapeseed and soybeans: confirmation of the producers status will be carried out through the Chamber of Commerce and Industry of Ukraine

After more than a month of delay, the Ukrainian government has finally approved a new procedure for exporting soybeans and rapeseed, which allows agricultural producers to legally avoid paying the 10% export duty. The state has introduced a new procedure to confirm the status of a producer — instead of automatic confirmation by tax authorities, this right has been transferred to the Ukrainian Chamber of Commerce and Industry (CCI), which will issue paper certificates of origin of the goods.

 

In accordance with the Resolution of the Cabinet of Ministers of Ukraine dated October 3, 2025 No. 1256 “Some Issues of Confirmation of Own Cultivation of Certain Types of Agricultural Products for Export Purposes” (entered into force on October 5, 2025), agricultural producers who export their own grown products under codes 1201 (soybean) and 1205 (rapeseed) according to the Ukrainian Code of Economic and Social Affairs, as well as agricultural cooperatives that export products grown by their members, are entitled to a benefit from payment of export duty.

 

The document confirming the exporter's right to duty exemption is an expert opinion on the origin of the goods, issued by the Chamber of Commerce and Industry of Ukraine or a regional chamber. Such an opinion is issued for each individual batch of agricultural products being exported.

 

The resolution does not apply to transactions carried out under commission, consignment, mandate or agency agreements, as well as to cooperatives created or registered after the entry into force of Article 1¹ of the Law of Ukraine “On Export Duty Rates for Seeds of Certain Types of Oilseeds”.

 

In accordance with the order of the Ministry of Finance of Ukraine dated 06.10.2025 No. 508, the Classifier of Documents, Certificates, Permits and Additional Information (approved by the order of the Ministry of Finance dated 20.09.2012 No. 1011) has been supplemented with a new document code "8053" - an expert opinion on the origin of goods issued by the Chamber of Commerce and Industry of Ukraine or a regional chamber, which confirms the manufacturer's right to a benefit from paying export duty.

 

According to Deputy Minister of Economy Taras Vysotsky, by December 1, producers must declare in accordance with the established procedure the area of crops under soybeans and rapeseed and the yield, which does not exceed 3.5 t/ha. At the same time, the volume of products exported cannot exceed the volume actually grown.

 

At the same time, the government clarified that the refund of already paid duties is not within the scope of this resolution and will require a separate legislative decision.

 

Recall that the 10% duty on soybean and rapeseed exports came into effect on September 4, 2025 and immediately caused a disruption in the market: shipments of rapeseed and soybeans from Ukraine decreased several times.
