The Government of Ukraine has clarified the procedure for exporting rapeseed and soybeans by agricultural producers without paying duties

The Government of Ukraine, by Resolution No. 1256 of October 3, 2025, clarified the procedure for exporting soybeans and rapeseed, according to which rapeseed and soybean producers will be able to export their own products without paying a 10% export duty.

 

The document establishes that agricultural producers, as well as agricultural cooperatives that export their own soybeans and rapeseed, must obtain an export certificate of origin from the Chamber of Commerce and Industry (CCI) of Ukraine or regional CCIs for each batch of exported products.


The specified mechanism does not apply to export transactions carried out on the basis of agreements on the provision of intermediary services (in particular, a commission agreement, consignment agreement, mandate, agency agreement), and to agricultural cooperatives established and/or registered after the entry into force of Article 11 of the Law of Ukraine “On export duty rates for seeds of certain types of oilseeds”.


At the same time, the Ministry of Economy, Environment and Agriculture has been instructed to develop and implement monitoring of the compliance of the information specified in expert opinions with the information contained in the State Agrarian Register, taking into account the volumes of agricultural products exported without paying customs duties.


After the resolution enters into force (from the moment of its publication) and until December 1, all agricultural producers who intend to export soybeans and rapeseed must register the size of the areas under the specified crops and their yield (which should not exceed 3.5 t/ha), and the volume of exported products should not exceed its actual production, said Deputy Minister of Economy, Environment and Agriculture of Ukraine Taras Vysotsky.


He also clarified that the refund of already paid duties to agricultural producers is not an issue of the aforementioned resolution and will require a separate legislative decision.
